Daniel Waldrep appeared Wednesday, February 11, 2026, before Judge Joseph F. Boedeker in 39th District Court in Roseville for a probable cause conference. At the request of defense counsel, the court referred Waldrep to the Center for Forensic Psychiatry to determine whether he is mentally competent to stand trial and whether he can be held criminally culpable. A review hearing is scheduled for April 15, 2026, at 8:30 a.m.

The charges stem from a violent incident on January 23, 2026. Authorities allege Waldrep, while intoxicated and armed, forced entry into his home and injured his wife before barricading himself inside. Prosecutors say he then fired a high-powered rifle at responding officers, striking a patrol vehicle and wounding one officer during the confrontation.

Waldrep is charged with multiple serious felonies, including:

  • Four counts of Assault With Intent to Murder, punishable by any term of years up to life
  • Possession of a Firearm by a Prohibited Person, a 5-year felony
  • Possession of Ammunition by a Prohibited Person, a 5-year felony
  • Attempted Disarming of a Peace Officer, a 10-year felony
  • Assaulting/Resisting/Obstructing a Police Officer, a 2-year felony
  • Domestic Violence, a 93-day misdemeanor
  • Six counts of Felony Firearm, each carrying a mandatory consecutive 2-year term

Prosecutors have also filed a Habitual Offender Third Offense notice, which could increase potential penalties if he is convicted.

Waldrep remains lodged in the Macomb County Jail on a $2 million cash/surety bond with no 10% provision.

Macomb County Prosecutor Peter J. Lucido said the competency review is a required step when questions arise about a defendant’s mental fitness.

“When questions arise regarding a defendant’s mental fitness, the court must pause the proceedings and obtain a professional evaluation,” Lucido said. “This step protects the fairness of the process and ensures that any outcome is legally sound. Addressing competency at the outset allows the case to move forward appropriately and upholds our responsibility to the victim and the community.”

Waldrep is presumed innocent until proven guilty in a court of law.
