Sentencing Delayed Again: Darius McCrary Now Facing 2027 Date In Oakland County Child Support Case

What was supposed to be a sentencing hearing this week for former “Family Matters” actor Darius McCrary has now been pushed back significantly.

McCrary had originally been scheduled to be sentenced Wednesday the 18th, but that date was moved to Friday. Now, according to a new report from TMZ, the judge has delayed sentencing until January 25, 2027.

TMZ reports the court ordered McCrary to stay away from firearms, maintain employment, and avoid contact with the woman involved in the case for the next 11 months. The outlet also noted McCrary’s son was present in court and submitted a letter indicating he does not consider himself a victim. The state has argued that children impacted by unpaid child support are victims regardless of personal feelings.

The most recent filing obtained by New Media Detroit is an Investigation / Attorney General Police Report dated August 21, 2024, but filed with the Oakland County Clerk on February 18, 2026.

According to the report:

• Complaint Type: Felony Non-Support

• Venue: Oakland County

• Suspect/Defendant: Darius Creston McCrary

• Amount of Support Order: $889 per month

• Total Arrearage at time of report: $75,473.26

The report states McCrary was ordered to pay child support through the Oakland County Friend of the Court and that records reviewed through the Michigan Child Support Enforcement System showed he had not paid as ordered.

The custodial parent is listed as Elizabeth Joy Swain. The report indicates the child has lived continuously with Swain since approximately age six and that she reported receiving no direct child support payments or assistance.

It is important to note the arrearage amount listed in the report is dated August 2024, meaning the current total could be different.

McCrary was arrested in October near the Mexico border on a Michigan warrant related to the case and later extradited back to Michigan. During earlier proceedings in California, he initially attempted to represent himself before being appointed counsel.

With sentencing now reportedly set for early 2027, the case stretches even further beyond what had already been a lengthy legal process.
