Mt. Clemens, MI – A Warren man has been arraigned on a felony charge after authorities say he failed to pay tens of thousands of dollars in court-ordered child and spousal support.
According to the Macomb County Prosecutor’s Office, Richard Allers, 57, of Warren, is charged with failure to pay spousal and child support, a felony punishable by up to four years in prison.
Prosecutors say the case stems from a Feb. 28, 2017 child support order issued by Macomb County Circuit Court Judge Tracey A. Yokich. The court later modified the order three times.
Authorities allege Allers failed to comply with the court’s orders and ultimately accumulated $42,935.54 in unpaid support. Officials said enforcement attempts and efforts to work with him on payment options were unsuccessful, and a bench warrant was issued.
“Courts issue spousal and child support orders to ensure people—especially children—have the financial stability they are legally entitled to. When individuals fail to follow these orders, they undermine both the well-being of their children and the authority of the court. Compliance is not optional; it is a legal obligation, and our office will continue to enforce these orders to protect those who depend on them,” said Macomb County Prosecutor Peter J. Lucido.
Allers was arraigned March 2, 2026 before Magistrate Ryan Zemke in the 41B District Court in Clinton Township, where bond was set at $10,733 cash only.
A probable cause conference is scheduled for March 10 at 8:30 a.m. before Judge Sebastian Lucido in the same court.
The prosecutor’s office noted that felony nonsupport charges are typically pursued when arrears exceed $5,000, payments have not been made for three consecutive months, and investigators determine the parent has the financial ability to pay.
Officials say the Family Division of the prosecutor’s office has collected more than $4.2 million in overdue child support since 2022.
All defendants are presumed innocent unless and until proven guilty in a court of law.
