Macomb County Prosecutor Peter J. Lucido announced that Daniellys Villegas-Moreno, 24, of Warren, was arraigned following the incident, which investigators say involved a firearm that was neither locked in a safe nor equipped with a gun-locking device.

The shooting allegedly occurred on Tuesday, January 20, 2026, at The Cove on 10 apartments when the toddler accessed the handgun and discharged it, injuring his hand. Authorities confirmed the child was transported for medical treatment and is in stable condition.

Villegas-Moreno, identified as the child’s mother, was arraigned on Tuesday, January 27, 2026, before Judge Michael Chupa in the 37th District Court in Warren.

Charge Filed

  • Firearms – Safe Storage Violation – Premises Under Individual’s Control – Minor Present and Injured Self or Another
Penalty: Felony punishable by up to 5 years in prison

Judge Chupa set bond at $10,000 cash or surety. As conditions of bond, Villegas-Moreno is prohibited from possessing, using, or being in the presence of firearms, must wear a GPS tether upon release, and is barred from leaving the State of Michigan.

“Michigan’s firearm safe storage statute is designed to reduce preventable deaths and injuries, including incidents of youth self-harm and gun-related violence,” Lucido said. “If a firearm is in a household where children could gain access, it must be stored in a locked container or fitted with a device that makes it unusable.”

She is scheduled for a Probable Cause Conference on February 10, 2026, followed by a Preliminary Examination on February 17, 2026, both to be held in the 37th District Court.

As in all criminal cases, Villegas-Moreno is presumed innocent unless and until proven guilty in a court of law.
